Lee Man Sentenced for Indecent Assault and Battery

PITTSFIELD, Mass. — On Monday, June 16, Dillon Curtin, 31 of Lee, was sentenced to two years in the House of Corrections.
 
Charges include Dissemination of Photograph of a Person in the Nude without Consent and two years' of probation to follow for Possession of a Firearm without a Firearms Identification Card, Improper Storage of a Firearm-10H (within a home), Possession of Class B Controlled Substance, Possession of Class C Controlled Substance, Possession of Class E Controlled Substance, and Indecent Assault and Battery. 
 
Conditions of probation are to register with Sex Offender Registry Board; possess no weapons; have no contact and stay away from the victim; and not disseminate the photograph further. The Honorable Judge Flannery presided.
 
The Commonwealth requested Curtin be sentenced two and a half years in the House of Corrections, with concurrent maximum sentences on all of charges, save the Indecent Assault & Battery. Defense requested Curtin be sentenced to two years' probation on all counts. Judge Flannery required Curtin to comply with sex offender registration.
 
The charges stem from an incident in October 2019 when Curtin asked the victim, who he was friends with at the time, to come to his house to cut his hair, something the victim had done in the past. The Commonwealth alleged Curtin drugged the victim in an alcoholic beverage. The victim awoke the next morning in her own bed with no memory of the previous night or how she got home. Two weeks later, the victim discovered that an elicit picture, for which she had no recollection being taken, had been sent by Curtin to another individual. Probable cause was found to search Curtin's house: upon execution investigators recovered an improperly stored shotgun and crushed pills.
 
Assistant District Attorney Andrew Giarolo represented the Commonwealth. Director of Victim Witness Advocates Jane Kibby-Peirce served the victim on behalf of the District Attorney's Office. Sargent Stephanie Burdick, Lee Police Department, and the State Police Detective Unit acted as the lead law enforcement agencies.
